1. About These Terms

These Terms & Conditions (“Terms”) govern your use of the website eastcoastdrones.com.au and any purchase of products or services from East Coast Drones (“ECD”, “we”, “us”, “our”), ABN 23 299 231 068, of 125 Vicarys Rd, Mundubbera, QLD 4626, Australia. By using this site, placing an order, or engaging our services, you agree to be bound by these Terms.

2. Products, Pricing & GST

  • All prices are listed in Australian Dollars (AUD).
  • All prices, quotes, and invoices include GST unless expressly stated otherwise in writing.
  • We take reasonable care to ensure product information, images, and pricing are accurate, but errors may occur. We reserve the right to correct pricing or description errors and to cancel/refund an order affected by such an error before dispatch.

3. Orders & Payment

Orders are confirmed once payment is received in full (or a deposit, for high-value/special orders — see 3.1).

3.1 High-Value & Special Orders

For agricultural drones, enterprise drones and other high-value or special-order equipment, we may require a deposit. The amount and any cancellation terms will be stated in the quote before you pay. A deposit may be retained if you cancel because you change your mind, to the extent stated in that quote and permitted by law. If we cannot supply the goods, we will refund the deposit. Nothing in this clause limits any remedy available under the Australian Consumer Law.

3.2 Retention of Title

Ownership of any product — whether purchased through our website or supplied as part of a service — remains with East Coast Drones at all times until payment has been received in full. Risk in the goods (loss or damage) passes to you on delivery or collection, but title does not transfer until full payment clears.

4. Shipping & Delivery

  • Delivery timeframes are estimates only and are not guaranteed.
  • Freight costs for large/heavy equipment are calculated separately and communicated prior to dispatch.
  • Delivery may be affected by manufacturer or import backorders, customs or dangerous-goods clearance, freight delays, road closures, flooding, extreme weather or industrial action. We will tell you about a material delay and work with you on the available options. Nothing in this section limits any right or remedy you have under the Australian Consumer Law.

5. Warranty

  • Products are covered by the applicable manufacturer’s warranty (e.g. DJI) and, where applicable, ECD’s own workmanship warranty on repairs and installations.
  • Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law (ACL) that cannot lawfully be excluded.

6. Returns & Refunds

Returns and refunds are handled in accordance with our Refund and Returns Policy and the Australian Consumer Law.

7. Drone & Agricultural Services

Where ECD provides flight services (aerial spraying, seeding, mapping, surveying, stock work, pest control):

  • All operations are conducted by CASA-licensed, fully insured operators in accordance with Australian aviation law and CASA regulations.
  • Services are subject to weather, airspace, site access and safety conditions at the time of operation. We may reschedule or cancel work where it cannot be carried out safely or lawfully, including because of wind, poor visibility, unsafe access, people or livestock in the operating area, airspace restrictions, fire, smoke or equipment faults. We will discuss rescheduling or any applicable refund with you. Your rights under the Australian Consumer Law continue to apply.
  • The client is responsible for providing accurate site information (boundaries, hazards, livestock, other aircraft/persons in the area) and any necessary landholder or third-party permissions.
  • Results of agricultural services depend on conditions beyond our control, including weather after application, soil and moisture conditions, pest or disease pressure, pre-existing crop condition, and accurate site and product information supplied by the client. We do not guarantee a particular crop, land or property outcome unless expressly agreed in writing. This does not limit our obligation to perform services with due care and skill or any other applicable consumer guarantee.

7.1 Ownership of Captured Data (Photos, Video & Maps)

  • Once an invoice for the relevant service is paid in full, ownership of the specific imagery, video, and map/survey deliverables produced for that job (e.g. 2D/3D maps, and multispectral scans — imagery captured in light bands beyond ordinary colour, used to assess crop and vegetation health) transfers to the client.
  • ECD retains a working copy of all captured data for internal records, quality assurance, and warranty/dispute purposes.
  • ECD will use imagery from a job for marketing or promotional purposes (e.g. website, social media) only where the client has given prior written consent. Consent may be withdrawn at any time by written notice, and ECD will remove the imagery from material within its control within 14 days of that notice.
  • How any personal information incidentally captured in this data (e.g. people, vehicles, neighbouring properties) is handled is set out in our Privacy Policy.

7.2 Mapping Data, Accuracy & Tolerances

Where a service includes aerial mapping, photogrammetry (building measurable maps and 3D models from many overlapping aerial photos), or other data-capture — for example 2D/3D maps, orthomosaics (one large, distortion-corrected aerial image stitched from many photos), elevation models, point clouds, or GIS layers —, the following applies in addition to clause 7 above.

Not a surveyor:

  • ECD is a CASA-licensed drone operator, not a registered or licensed cadastral, land, or engineering surveyor, and does not hold surveying qualifications or professional indemnity insurance for surveying advice.
  • No deliverable constitutes a survey and none may be used as a substitute for one.
  • The client acknowledges and agrees that ECD deliverables must not be lodged with, submitted to, or relied on for any purpose before the Queensland Titles Registry (or the equivalent body in any other State or Territory), and must not be used to determine, mark, dispute, or evidence a cadastral boundary, land title, subdivision, easement, lease area, or resumption.
  • Deliverables must be used only for the purposes and accuracy level agreed in the written quote. The client is responsible for obtaining a registered surveyor’s advice where a certified survey is required. Nothing in this clause excludes any right or remedy that cannot lawfully be excluded.
  • Where the client’s intended use requires certified survey accuracy, the client must tell ECD before the job is booked so ECD can decline the work or refer the client to a registered surveyor.

Accuracy is indicative, not certified:

  • Positional accuracy depends on the equipment and method used, and on site conditions on the day. ECD does not state accuracy tolerances in these Terms. Where accuracy matters to the client’s intended use, the accuracy level ECD will work to must be agreed and recorded in the written quote for that job.
  • Without GCPs, positional accuracy relies on the drone’s onboard GNSS only and is not survey-grade. Where a specific accuracy level is required, it must be agreed and quoted in writing in advance, and may require GCPs and/or RTK/PPK equipment.
  • Vertical accuracy is generally lower than horizontal accuracy. Photogrammetry maps the visible surface (e.g. crop or tree canopy), not the bare ground beneath it, unless specifically processed and validated for that purpose.

Weather and environmental conditions affect data quality, not just whether the job proceeds:

Clause 7 above covers whether a job goes ahead in poor weather. Separately, even where a flight does proceed, conditions on the day affect the accuracy and usability of the resulting data:

  • Wind affects flight stability, which can reduce image sharpness and the consistency of image overlap used to stitch the final map.
  • Cloud cover and inconsistent light cause uneven shadow and colour balance across an orthomosaic, and reduce the reliability of vegetation/crop-health indices (e.g. NDVI) captured with multispectral sensors.
  • Rain, fog, haze, smoke, or high humidity reduce image clarity and may delay or prevent capture altogether.
  • Extreme heat or cold affects battery performance and aircraft endurance, which can affect area coverage or require multiple flights to complete a site.
  • Strong or gusty wind and low light (near dawn/dusk) increase GNSS positioning noise and can reduce accuracy independently of any GCP correction used.
  • All accuracy figures provided by ECD are indicative only and vary by site, equipment, and conditions on the day of capture.

Appropriate use of mapping deliverables:

  • Suitable for: general site reference, progress monitoring, visual inspection, vegetation/crop-health mapping, and approximate area/volume/stockpile estimates.
  • Not suitable for, and must not be relied on for: cadastral or boundary determination, land title or subdivision purposes, engineering design or construction stake-out/set-out, or any purpose requiring certified survey accuracy. For these, engage a surveyor registered in the relevant State or Territory (in Queensland, with the Surveyors Board of Queensland).

Third-party processing software:

  • Deliverables may be produced using Pix4D (photogrammetry processing software) and QGIS (open-source GIS software), and may be supplied as georeferenced PDF maps for field use via Avenza Maps. ECD is not the developer of these platforms and does not warrant they are free of bugs or defects.
  • Positioning shown on a mobile device within Avenza Maps depends on that device’s own GPS chip, which is materially less accurate than the drone/GCP-corrected data used to produce the map, and is indicative only — it must not be relied on for precise on-ground positioning.
  • The client is responsible for having appropriate, licensed software to open and use delivered files.

Currency and client verification:

  • Captured data reflects site conditions on the day of the flight only and should not be relied on as current after significant site changes (earthworks, vegetation growth, stockpile movement) without a fresh flight.
  • The client must independently verify any measurement, area, volume, or position before relying on it for a decision with financial, legal, or safety consequences, and must not rely on a deliverable alone for chemical application rates, earthworks quantities, fencing or infrastructure placement, or any decision affecting a boundary, and is responsible for arranging any GCPs required where a higher accuracy level has been agreed.

8. Repairs & Leasing

  • Repair quotes are estimates; final cost may vary once the fault is diagnosed. Approval will be sought before chargeable work proceeds beyond the quote.
  • Leased equipment remains the property of ECD at all times and must be returned in the condition specified in the individual lease agreement. Loss, damage, or late return may incur additional charges as set out in that agreement.

9. Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded or limited. Where a product has a major failure under the Australian Consumer Law, the consumer may choose a refund or replacement. For a minor failure, we will provide a remedy in accordance with the law.

East Coast Drones is responsible for handling applicable consumer-guarantee claims for products it sells. A manufacturer’s warranty may provide additional rights; we will not require you to pursue the manufacturer instead of us to exercise your rights against us.

For claims that are not subject to non-excludable rights, liability is limited only to the extent permitted by law. We are not responsible for loss to the extent it is caused by misuse of equipment, inaccurate information supplied by the client, or use of a mapping deliverable outside the purpose and accuracy level stated in the written quote.

10. Intellectual Property

All content on this website (text, images, logos) is owned by or licensed to ECD and may not be reproduced without permission.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of Queensland, Australia. Disputes must first be resolved through good-faith discussion. If unresolved, they are subject to the exclusive jurisdiction of the courts of Queensland.
